Abstract

This research discuss about traditional cultural expression ethnic Iban as intellectual property. Traditional cultural expression or more commonly known as TCE is one of the cultural product that can provide the symbolism and highlight the privilege owned by the community. Production of TCE usually only used for custom such as medical and rituals. But some have been abuse such as happened to society which is their folk songs have been exploited and commercialized without their knowledge. These cause communities do not get any compensation (Chee Ying, 2005). These researches also stress to the expression of the traditional cultural of intangible in particular Iban folklore in Sarawak. The main focus of this research discuss the protection against traditional cultural expression of intangible placed under the Copyright Act 1987 and examine the problem an abuse of product based on the expression on the traditional cultural. These research using qualitative, focus on exploratory research as design research. Exploratory researches used due to look of information about subject research also use three method focuses on documentary method, review case study also interview. Research result found that placement of traditional cultural expression (intangible) under Copyright Act 1987 less appropriate because need to follow some criteria already set by Malaysia Intellectual Property Organization (MyIPO) which is in term of the author, originality S.27(3)(a), the duration of protection as well as the concept of absolute ownership S.26(1) and S.27(4).
